Service Terms & Liability Waiver

Version 2.2

1. Property Access

You authorize Furensical and its representatives to enter your property, including fenced yard areas, during the service windows you've scheduled, for the purpose of performing pet waste removal and related services. Any gate code or access instructions you provide are used only to complete your scheduled service and aren't shared beyond the technician assigned to your visits.

2. Assumption of Risk

Yard work carries inherent risks — uneven terrain, holes, buried or hidden objects, sprinkler equipment, weather conditions, and exposure to animal waste among them. You accept these risks as a normal part of the service.

3. Pet Information & Safety

You agree that any information you provide about your pets (temperament, bite history, aggression) is accurate and current, and you'll update it if it changes. If a pet has shown aggression toward people, you're responsible for securing that pet (e.g., keeping it indoors) during the scheduled visit unless you've arranged otherwise with Furensical in advance.

4. Photos & Health Analysis

During visits, Furensical's technicians may take photos, including a photo used to generate an automated wellness note about your pet ("Health Analysis"). Health Analysis is produced by an AI model based only on what's visible in that photo. It is not a veterinary diagnosis, is not created or reviewed by a veterinarian, and is never a substitute for your own veterinarian's judgment. Always consult your vet directly for any actual health concern, regardless of what Health Analysis says.

5. Data Collection, Use & Disclosure

Furensical collects information needed to provide service, including your contact information, address and access details, service history, photos taken during visits, and Health Analysis results. Furensical may use this information to provide and improve its services, and may share or sell it — including in de-identified, aggregated, or identified form — with third parties for purposes such as research, product development, or commercial partnerships.

Furensical keeps this information for as long as you're an active customer and for a reasonable period afterward for business and legal purposes, and will delete or de-identify it on request where it isn't otherwise required to keep it. You may ask Furensical at any time not to include your data in a future sale or share with a third party.

The Colorado Privacy Act, and similar laws in other states, may give you additional rights over your personal data depending on where you live — including the right to know what's been collected and to request its deletion. To exercise any of these rights, or with any question about how your data is used, contact Furensical directly.

6. Limitation of Liability

To the maximum extent permitted by Colorado law, Furensical's total liability for any claim arising from a service visit, or from your use of or reliance on Health Analysis, is limited to the amount you paid for that visit. Furensical is not responsible for pre-existing lawn or yard conditions, or for the behavior of your own pets.

7. Your Responsibility to Furensical

You agree to indemnify and hold Furensical harmless from losses, claims, or expenses arising from inaccurate information you provided (for example, an undisclosed dangerous pet), your own negligence, or your violation of this agreement.

8. What This Waiver Does Not Cover

Nothing here waives or limits liability for gross negligence, willful misconduct, or violations of law by Furensical — agreements can't legally eliminate responsibility for those, and this one doesn't try to.

9. Payment Terms & Billing

If you subscribe to recurring service, your payment method is billed automatically on the cadence you were quoted (weekly, twice-weekly, or biweekly) through Stripe. Prices may change with reasonable advance notice. If a payment fails, Furensical may pause service until it's resolved.

10. Cancellation Policy

You may cancel your subscription at any time, either by contacting Furensical directly or through the billing management link available in your customer portal. Cancellation takes effect at the end of your current billing period — Furensical doesn't refund already-completed service periods unless otherwise agreed in writing.

11. Weather & Missed Visits

Furensical isn't liable for a delayed or missed visit caused by severe weather, a natural disaster, road closures, or other circumstances outside its reasonable control. If a technician can't access your yard on a scheduled day — a locked gate, an unrestrained aggressive dog, or a gate code that no longer works, for example — Furensical will attempt to reschedule or notify you, but a missed visit for a reason like this doesn't by itself entitle you to a refund or credit.

12. Notices & Disputes

Either party may give notice under this agreement by phone, text, or email to the contact information on file. Before filing a lawsuit over a dispute arising from this agreement, both parties agree to first try to resolve it informally by contacting the other directly.

13. Governing Law, Entire Agreement & Severability

This agreement, together with the pricing and service details you were quoted, is the entire agreement between you and Furensical about your service — it replaces any earlier discussion or understanding. It's governed by the laws of the State of Colorado. If any part of it is found unenforceable, the rest remains in effect.

14. Acknowledgment

By checking "I agree" when requesting service, you confirm you've read and understood this agreement and accept it as a condition of receiving service.
